Businesses can claim refunds for Trump tariffs ruled unconstitutional starting Monday

A new refund system is set to launch for businesses that paid tariffs imposed by former President Trump, which the U.S. Supreme Court ruled were unconstitutional. Starting Monday, importers can claim refunds through an online portal managed by U.S. Customs and Border Protection. This process could eventually lead to consumer refunds for tariffs on imported goods. Companies must submit detailed declarations of goods taxed under these tariffs, and approved claims will be refunded within 60-90 days. The Supreme Court found Trump overstepped his authority by setting new import tax rates, a power reserved for Congress. Not all imports are immediately eligible for refunds, and importers must register with CBP’s electronic payment system. As of mid-April, over 56,000 importers were eligible for refunds totaling $127 billion. The process requires accuracy, and technical issues may arise as the system goes live.
